Kisumu High court has ordered the Kisumu Dala 7s tournament to continue on August 9th and 10th as scheduled and that Fred Maube take over as the secretary.
In a ruling made this morning, Senior Magistrate Harrison Adika also ordered that Paul Okongo should not participate on anything to do with rugby until the end of Kisumu Dala 7s.
Earlier, the applicants through Collins Orieyo and advocates of the high court of Kenya had tabled a certificate of urgency accusing the chairman and his secretary together with Giro Commercial bank LTD for conspiring to defraud the Kisumu rugby football club off sponsorships funds by unlawfully and illegally obtaining sponsorship on behalf of the club and imposing illegal signatories to operate the clubs bank account held at Giro Commercial Bank limited.
Kisumu Rugby Football Club was in trickier position after two factions of officials have made it impossible to run affairs at the club.
The club’s Kenya Rugby Union recognised(KRU) officials, led by secretary Frederick Maube moved to court last week to freeze the club’s account, after Safaricom deposited Sh1 million to its Giro Bank account to aid preparations for Dala Sevens.Safaricom deposited following talks with former KRU chief executive officer Jack Okoth and Paul Okong’o, who introduced himself as club secretary during a meeting.
Kisumu Rugby Football Club’s officials have, in their court papers, accused Okong’o, Okoth and the KRU of “conspiring to defraud it of money meant for sponsorship of the tournament.”
“Okong’o and Okoth, who is a former union employee, approached Safaricom and managed to get the funds deposited to the account. The account was frozen because KRU does not recognise the two as officials,” said Omondi.
Contacted, Okong’o said he was the club’s secretary and planning of the Dala Sevens was ongoing despite the lack of funds in the club’s account.
The case will be mention in court within 30 days.
